    Ford Hit With $43 Million Verdict on Lincoln Town Car

    An Illinois jury has ordered Ford Motor Co. to pay $43 million in
    damages to the family of a 74-year-old man who died from severe burns in
    a fuel-fed fire when his 1993 Lincoln Town Car was hit by another vehicle.

    Attorneys for the family of the victim, John Jablonski, argued that the
    design of the fuel tank on the Town Car increased the risk of fire after
    accident impacts. Jablonski's wife, Dora, suffered serious burns but
    survived.

    Lead attorney Brad Lakin of the Lakin Law Firm in Alton, Ill., said in a
    statement, "This is an important case for the Jablonskis, who suffered
    horrible injuries, but it has national implications for those whose
    lives were put at risk due to this fuel tank design."

    The 1993 Town Car was manufactured with a vertical behind-the-axle fuel
    tank, a design Lakin said was linked to numerous deaths.

    "Ford knew this design was dangerous yet took no action to protect the
    public," the attorney said in his statement.

    James Feeney of Dykema Gossett in Bloomfield Hills, Mich., lead attorney
    for Ford, said in a telephone interview that the verdict will be
    appealed should post-trial motions be denied.

    Feeney said improper jury instructions created a post-sale duty to warn
    on the part of Ford, a cause of action contrary to current Illinois law.

    Interviews with jurors after the verdict indicated that they decided the
    case strictly on this duty, Feeney noted, and "paid no significant
    attention" to the company's defense of the defect claims.

    Dora Jablonski was awarded $1.7 million for past and future medical
    care, $1.9 million for past and future medical assistance, $6.5 million
    for disability, $6.5 million for pain and suffering, and $6.5 million
    for disfigurement.

    The John Jablonski estate was awarded $67,715 for the decedent's medical
    expenses, $500,000 for disfigurement and disability, $1 million for pain
    and suffering, and $3.5 million for loss of society.

    The Madison County Circuit Court jury deliberated for four hours
    following the two-week trial.

    Jablonski et al. v. Ford Motor Co., No. 03-L-2-27, verdict returned
    (Ill. Cir. Ct., Madison County Apr. 18, 2005).
